📂Изменения в ТК РФ: компенсация за работу в выходные
Накануне выходного дня делимся инициативой, которая поступила в Госдуму РФ:
➡️ предлагается закрепить в ст. 153 ТК РФ, что при увольнении нужно компенсировать работнику неиспользованные дни отдыха за работу в выходные и праздники.
Что значит компенсировать?
Работнику положена разница между повышенной оплатой (вместо которой он выбрал отгул) и той, что уже начислили в одинарном размере.
▶️Также хотят также уточнить, что:
🔵работник вправе использовать день отдыха в течение года с даты выполнения обязанностей в выходной или праздник 🔵ИЛИ присоединить отгул к отпуску в этом периоде.
Если законопроект примут, то поправки вступят в силу с 1 марта 2025 года.
Очевидно, данный законопроект разработан «по следам» Постановления КС РФ от 06.12.2023 N 56-П, в котором суд указал на необходимость компенсировать неиспользованные отгулы за работу в выходные и праздники.

Export WhatsApp stickers to Telegram on Android
